PrisonFriendship.com, LLC – Terms of Service (“Agreement”)

Please read these Terms of Service (“Terms”) before using the website and services provided by PrisonFriendship.com, LLC (“PrisonFriendship,” “we,” “us,” or “our”). These Terms are a legally binding agreement governing your access to and use of our website, social media, and related services (collectively, the “Site”).

By visiting, browsing, or using the Site in any way—including submitting content, creating or renewing a profile, clicking “Accept” or “Agree,” or mailing a paper application—you agree to these Terms.

1) Eligibility

• You must be 18 years of age or older to access, view, or use the Site.
  
  
• We do not accept applications from anyone convicted and currently incarcerated for any crime against a minor, unless the applicant was a minor at the time of the conviction. In those cases, we may review the circumstances (if information is available) and decide at our sole discretion.
  
  

2) Acceptance of Terms

You agree to be legally bound by these Terms when you:

• Use or attempt to use the Site;
  
  
• Click “Accept” or “Agree” on the Site; or
  
  
• Submit a hard-copy application and sign the required disclaimer.
  
  

By agreeing to these Terms, you acknowledge that we are not liable for disputes arising under or related to these Terms except as required by applicable law.

3) Accurate Information & Fraud

You must provide truthful, complete, and accurate information. Failing to disclose relevant information (e.g., a conviction for a crime against a minor if you are currently incarcerated) or submitting fraudulent information violates these Terms. We may suspend or remove profiles and deny refunds in such cases. We reserve the right to amend or change these Terms at any time.

4) Intellectual Property & Promotional Use

• The Site and all original content are the exclusive property of PrisonFriendship.com, LLC and are protected by applicable intellectual property laws.
  
  
• We reserve the right to use any member content (including images, text, artwork, videos, poetry, blogs, etc.) for promotional purposes on our website and social media, during and/or after your profile has expired or been removed.
  
  
• All content on our website and social media belongs to PrisonFriendship and may not be copied, redistributed, or reproduced without our prior written permission. Unauthorized use may result in legal action.
  
  
• We promote our platform on multiple social media channels. We are not responsible for comments made by the general public on those platforms. We may select which channels to use at our sole discretion.
  
  

5) Termination & Refunds

• We may terminate or suspend your access to the Site or remove your profile at any time, without notice, including (but not limited to) for submitting fraudulent information or violating these Terms.
  
  
• If you request to terminate your profile after it has been posted, no refunds will be issued. Once a profile is posted, our obligations are considered fulfilled.
  
  
• If you (or someone assisting you) request to terminate before the profile is posted, we will issue a refund. Please allow up to 14 days for processing.
  
  
• Any member found to be misleading others for money, perpetrating fraud, scamming, or otherwise violating Title 18, U.S. Code, Section 134 will be removed immediately and may be subject to prosecution.
  
  

6) Links to Third-Party Sites

The Site may contain links to websites or services not owned or controlled by PrisonFriendship. We are not responsible for the content or practices of third-party sites. We strongly recommend reviewing their terms and privacy policies before using those sites.

7) Governing Law

This Agreement is governed by the laws of the State of Ohio, United States, without regard to its conflict of laws rules.

8) Changes to These Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on the Site and highlight any material changes. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, please discontinue use of the Site.
